      Book Description

This book represents the fruit of a conference held in Oxford on March 3, 2006 under the auspices of the Institute of European and Comparative Law in the Oxford University Law Faculty. Directive 2005/29 is an important new measure in the construction of a legal framework apt to promote an integrated economic space in the European Union. It establishes a harmonised regime governing the control of unfair commercial practices. As such it represents an important exercise in the use of new rules and new techniques, and therefore poses new challenges to EU lawyers. The purpose of this book is to inform and to explore the issues raised by the Directive, issues which are of academic and practical interest, in helping to understand the evolution of European consumer law within the broader programme of European market regulation. The intense practical significance of this Directive, which heralds a new regime, is likely to provoke commercial operators to seek to exploit opportunities to pursue practices previously suppressed.

The key role of "incentives" in family law is considered in this economic approach to family law. The book discusses the possible adverse consequences emanating from faulty legal design, while demonstrating that good family law should provide incentives for consistent and honest behavior. Economists, specialists in the economic analysis of law, and academic lawyers discuss recent advances in specialized studies of marriage, cohabitation, and divorce. This important new work will be of considerable interest to lawyers, policy-makers and economists concerned with family law.

What sort of contract is marriage? What does it offer the parties? What are the difficulties of enforcement, and the result of failed effective enforcement? This book takes an economic approach to marriage and divorce, considering the key role of 'incentives' in family law: it highlights the possible adverse consequences emanating from faulty legal design, while demonstrating that good family law should provide incentives for consistent and honest behavior. Economists, specialists in the economic analysis of law, and academic lawyers discuss recent advances in specialist work on marriage, cohabitation, and divorce. Chapters are grouped around four topics: the contractual perspectives on marriage commitment; the regulatory framework surrounding divorce; bargaining and commitment issues relating to marriage and near-marriage arrangements; and finally empirical work, which focuses on the impact of more liberal divorce laws. This important new study will be of considerable interest to lawyers, policy-makers and economists concerned with family law.

          Book Description

This casebook on retailing contains seventeen new cases illustrating the key issues facing European retailers today. The cases have been contributed by some of the top European experts in the field and are based on companies familiar to students across Europe. While taking a practical approach, these cases are designed to illustrate the complex nature of retail activity and the importance of culture in retailing. The cases are not simply stories of how these firms undertook particular activities. Each of them deals with a specific set of issues and is written to enable exploration of these issues. Some of the cases deal with conditions which no longer concern the particular firm but illustrate a general issue applicable to retail management. Companies discussed include Promodes, Ikea, The Body Shop, Shoe Express, Benetton, and Häagen-Dazs amongst others. The cases demonstrate some of the similarities and differences facing retailers from different countries, and include questions which enable exploration of key aspects of retail strategy or operations.

To present a comprehensive analysis of the concept of privatisation its origins and limits, (b) To identify the legal and institutional framework for privatisation in different European countries from a comparative perspective; (c) To define and analyse particularly legal issues which arise during the privatisation transactions: e.g. labour law, competition law etc.; (d) To evaluate which features of the successful legal and organisational framework of privatisation have been successful so as to provide guidelines for those individuals and organisations participating in the privatisation exercises. This work found out that there is no simple, internationally applicable recipe for privatisation; various legal methods and techniques can be used to privatise state owned enterprises. Because each country has different circumstances, it is impossible to provide a unique model for privatisation; each country needs to design its own model according to its circumstances. Privatisation is an essential but insufficient element for structural economic reform in the economy and society. Privatisation is not a panacea, it is not the solution to every economic and administrative problem; selling an enterprise to the private sector does not mean an end to all problems. Also privatisation is not an overnight process or a magic touch; it will be a lengthy process. Furthermore, a decision that something can be privatised does not mean that it should be privatised. In that context, privatisation is not good or bad; it is an economic and social instrument. If it is well designed it may bring substantial benefits to the economy and society. In many countries, many state owned enterprises, particularly the ones which are financially weak, have still not been privatised. This finding revealed that the privatisation process will be in the political and economic agenda for at least few more decades.

                Book Description

This international comparison of pension plans lends great understanding to the transformation taking place in almost every nation around the world. It covers ten of the twelve countries of the European Union, as well as the United States and Japan. The project is interdisciplinary, covering a number of fields, such as economics, law, actuarial science, sociology, and political science, that contribute to the analysis of retirement income systems. The chapters vary in scope - some are comparative, some are restricted to a single country or to one type of plan in one country. Despite their diversity, the chapters share a common awareness of three aspects of pension plans: the importance of actors' roles in shaping each system, the different economic and social domains affected by retirement plans, and the interconnections between social security and supplementary plans.

                Book Description

The historic European Union Directive on Data Protection will take effect in October 1998. A key provision will prohibit transfer of personal information from Europe to other countries if they lack "adequate" protection of privacy. If enforced as written, the Directive could create enormous obstacles to commerce between Europe and other countries, such as the United States, that do not have comprehensive privacy statutes.

This book provides the first detailed analysis of the sector-by-sector effects of the Directive. It examines such topics as the tension between privacy laws and modern information technologies, issues affecting a wide range of businesses and other organizations, and effects on other prominent sectors with large transborder data flows. The book concludes with detailed policy recommendations on how to avoid a coming trade war with Europe.

                Customer Reviews:

5 out of 5 stars For those who loves privacy.......2000-04-29

This is a necessary tool to every person, not only to lawyers, interested to know how the "personal data protection" works in the European Union. You will be surprised with the similarities between the privacy regimes in Europe and the United States, notwithstanding this systems differ in important particulars. The book includes the study of the ways in which restrictive data protection law may clash with free trade agreements signed by the US and the members of the EU, as the World Trade Organization. The book is highly recommended.

                  Book Description

This study analyzes the legal framework imposed on corporations by the imperial Russian Government. It stresses the dual nature of the bureaucracy's policy toward modern capitalist enterprise: encouragement for the sake of economic development, and regimentation in the interest of maintaining autocratic control. By illuminating the political nature of the autocracy's economic agenda, Professor Owen seeks to explain why Russian corporate law became increasingly restrictive toward the end of the imperial period. Attention is also given to the practices of Russian capitalists, whose occasional abuses of corporate power justified restrictive laws in the eyes of officials.

                      Book Description

In the 1990s, institutional and evolutionary economics emerged as one of the most creative and successful approaches in the modern social sciences. This timely reader gathers together seminal contributions from leading international authors in the field of institutional and evolutionary economics including Eileen Appelbaum, Benjamin Coriat, Giovanni Dosi, Sheila C. Dow, Bengt-Åke Lundvall, Uskali Mäki, Bart Nooteboom and Marc R. Tool. The emphasis is on key concepts such as learning, trust, power, pricing and markets, with some essays devoted to methodology and others to the comparison of different forms of capitalism. An extensive introduction places the contributions in the context of the historical and theoretical background of recent developments in economics and the social sciences.

Essential reading for lecturers, researchers, graduates and advanced undergraduates in economics, business studies and sociology, this diverse yet complementary collection of essays will also find a broad readership among those wanting to understand the manifest changes apparent within modern socio-economic systems.

                        Book Description

In this study, Matejko proposes the organization as a social phenomenon. The discrepancy between organizational demands and organization capacity leads to organizational stress. Because of the conflicting demands on available resources, organizations are, in reality, "tension-management" entities. There is the tendency in organizations to resist actions which do not serve their own purposes. This leads to a lack of commitment among organization members, slowing down of the socialization process, and undermining managerial effectiveness.

5 out of 5 stars Perfect Loss Prevention Book!.......2003-12-05

All I needed to read in this excellent book was Chapter One. The author is right, ideal loss prevention is all in the Mindset. The tone is set from the first page on that loss in a business just isn't acceptable. That's a winning attitude if ever there was one. If you have Mr. Copeland's mindset, you can accomplish all the great profit-protecting ideas he presents in all the remaining chapters.

This is a sensible book, with common sense throughout its sixteen chapters. We're not taught business common sense anymore it seems, so this book is indeed refreshing.

After the Mindset, I was especially impressed with the cash protection chapter, and then all the remaining information that I'm using to protect my assets today. It works!

We're practicing absolutely zero loss in my business every day now, and we're all the better for it. This book is mandatory reading for my employees. Fine book.

                          5 out of 5 stars ABSOLUTELY FANTASTIC!!!.......2003-11-28

My first reaction was,"how can I possibly achieve that goal?" One chapter into this book and I understood that not only could I get there, but I had to get there. There is no other choice in today's business climate. Zero Loss is it!

I always look for a book that is positive, downright informative, and totally worth my precious time. This is that book. I learned important lessons on every page. Every sentence seemed perfectly relevent to my business, my employees, and my future.

We entrepreneurs and business managers want results; that's all that keeps us on top. Reading Mr. Copeland's book brings in the results, in a format that is easy to apply to about any business, if not every business. It is obvious that this author is an expert who has "been there and done that."

For knowledge delivered in an intelligent manner that just makes perfect sense, I absolutely recommend Absolutely Zero Loss.

4 out of 5 stars Essential Tools and Attitudes for Small Businesses.......2001-03-22

An excellent source of ideas and facts about the illegal ways that a small business (or a large one really) can lose money through theft and other unanticipated mechanisms (loss) and how to prevent them.

                          Funny to, keeps your interest.
