        The TRIPS Agreement is the most comprehensive and influential international treaty on intellectual property rights. It brings intellectual property rules into the framework of the World Trade Organization, obliging all WTO Member States to meet minimum standards of intellectual property protection and enforcement. This has required massive changes in some national laws, particularly in developing countries. This volume provides a detailed legal analysis of the provisions of the TRIPS Agreement, as well as elements to consider their economic implications in different legal and socio-economic contexts. This book examines the obligations imposed on WTO Members in different fields of intellectual property, and thoroughly explores the flexibilities that they enjoy in implementing the Agreement. It discusses the interpretation of the Agreement's provisions and the WTO jurisprudence already developed on certain aspects of the Agreement. It also includes a brief discussion on emerging issues such as protection of traditional knowledge, and on options for further developments e.g. copyright in a digital environment, and the relationship with competition law. It also takes into account recent developments in bilateral agreements and free trade agreements that contain TRIPS-plus standards of protection.             World hunger, jobs, the overall economic prospects of developing and developed countries alike are all being influenced by the international negotiations about trade, agriculture, services, investment and intellectual property rights going on at the World Trade Organization (WTO). Based on interviews with the participants, this remarkable book lifts the shroud of secrecy surrounding these ostensibly democratic negotiations.

            What emerges is a disturbing account entirely at odds with the official picture of a rules-based consensus emerging out of multilateral trade discussions in which all WTO member countries are equal participants. In reality:

            · Closed doors rather than open access and public information is the preferred mode of negotiation;

            · Decisions are often being made without the full approval of developing countries;

            · The tiny delegations of the poorest and smallest countries have only a limited capacity to calculate in advance the implications of what they are being asked to sign up to;

            · More seriously still, there are instances of illegitimate pressures and inducements being offered by the US and EU delegations - including threats to report non-compliant Third World delegates to their superiors, and hints that aid to countries refusing to kow-tow may be withheld.

            The revelations contained in this book are of enormous importance to all those concerned that international institutions should be more transparent and democratic, and that the rules being developed for the world economy should primarily be geared to solving the pressing humanitarian problems of poverty, hunger, jobs and improvements in the standards of living of all those being left behind by the process of globalization.

                This volume is a unique study on the highly controversial issue of standard of review in WTO dispute resolution. Standards of review reflect the extent to which the WTO adjudication bodies can override the decisions taken by national authorities.                 China surpassed Japan in 2003 to become America's 3rd largest trade partner, after Canada and Mexico. Indeed, it won't be long - a couple of years at most - before China overtakes Mexico's position. In addition, China is already the world's 4th largest merchandise trader after the US, EU and Japan, and one of the top leading overall (merchandise plus services) trading nations of the world. By the end of this decade, perhaps before then, China will take over Japan's place as the world's 3rd largest overall trader in both merchandise and services - an astonishing performance for a country which practically did zero trade with the rest of the world only 25 years ago.
