5 out of 5 stars Super Guide for Anyone Doing Business Globally.......2003-11-03

In a relatively short time, we've moved from doing business with our neighbors to doing business with people we may never meet in places we may never go...in languages we don't speak. This is all part of the increasingly rapid globalization of our economy. With different cultures come different rules of engagement. Pardon the pun, but business today is a different world than it was just a short time ago.

Hicks, a consultant to companies doing business globally, knows his field. Reading this book is like sitting down for a comfortable living room conversation with an expert. You'll gain a deep appreciation for how global business is different, what to watch for, and what can get in your way. The text is well-illustrated with stories, examples, and insights that will enable readers to substantially increase their chances of success on the international playing field.

You'll learn about cross-cultural behaviors that will undoubtedly open your eyes. The knowledge about cross-cultural business skills, negotiation, sales, and customer service will put you strategically ahead of the competition. Hick addresses how to make global alliances work and how to deal with gender issues. The downside is covered, too, so you'll know about vital issues about bribery, corruption, and legal issues. The question of dangerous destinations is particularly valuable in today's volatile world.

This is the kind of book that will hold your attention as you begin. You'll want to keep reading, which can interrupt your productivity. Don't try to read Global Deals at work. This one is best absorbed in the curl-up-in-the-comfy-chair kind of reading. The stories will draw you in; you'll be surprised how much you're learning.

A bibliography and index add to the book's value, enabling you to use the book efficiently for reference later. Suggestion: after you've read this book, invite your colleagues to read it, too, strengthening your company's capacity to do business in the most effective way on the global stage.

5 out of 5 stars A must for global managers.......2003-12-05

For almost 40 years,I have been traveling the globe selling high tech systems.
Global Deals aptly describes the events of all those many years. But I learnt the hard way and Oh! How I wish Michael Hick's book was in my briefcase.

This is an interesting, informative read written in anecdotal style, which suits the busy business traveler. You can read a chapter and put in down and go back to it a day later and read that chapter again or read another chapter and always the result is a learning process.

I consider myself an expert on the subject and can assert that in this book he has captured all the essential ingredients of what makes for a successful deal on a global basis. From the most simple to the most complex of ideological, cultural and business elements, he shows how the other side tends to approach a deal and what our thinking process should be.

Now more than ever, technology allows global deals to be accomplished behind a desk. Even more reason to understand the cultural, psychological, business, language and other differences that make global deal exciting and rewarding.

For those that don't want to learn the hard way, this book is the answer.

5 out of 5 stars Global Deals.......2003-10-16

Michael Hick has written an extremely readable book that explains the reasons for many misunderstandings between people of different cultures. Every person who has any international contacts should read this book. The "cultural clash" is brought into sharp focus. An excellent read with interesting, real life, illustrations.

5 out of 5 stars A Masterpiece!.......2003-08-11

Before you end up in the international markets saying, "Help! What am I supposed to do now?", avoid that predicament by reading Michael Hick's "Global Deals". That way, you will start out with the guidance of an experienced global businessman, an enthusiastic mentor who has "been there, done that" in every corner of the global market for over 40 years. In a sense, to read this book is to go to a party of colorful global marketing pros, where you can learn from their anecdotes, their gaffes, their hilarious or embarrassing mistakes, their years on the road, their lessons for the uninitiated. From all of this accumulated wisdom, the author pulls together advice, rules, checklists, warnings, but mainly his perception and sensitivities about the various cultures, in order to give you the main thing he wants you to have: a "global mindset": a way of understanding, accepting, appreciating, and doing business with a rich variety of people in the world who are waiting to buy from or sell to your companies. With special chapters dealing with the role of women in international markets, and even with protecting yourself against kidnapping in some countries, "Global Deals" is definitely a "must read" for every businessman who realizes that his market is now global. It is a thorough handbook that should be in every businessman's briefcase.

Book Description

You've been screwed.

You've been bludgeoned, skewered, crushed, mutilated by the stock market. Every day you read about another corporate scandal: loans to CEOs that didn't have to be repaid, accounting "irregularities," profits that never existed. You think the stock market must have been rigged. And you're right.

You were betrayed by the stock promotion machine -- the mutual fund managers, the brokers, analysts, strategists, and stock gurus who brainwashed you into buying and holding and believing that stocks, like parents, always come through and bail you out in the end.

So now what do you do? Where do you put your money? You can't just leave it in the bank or stuff it under the mattress.

For fourteen years Jim Cramer ran a hedge fund that compounded money at a rate of 24 percent annually after fees, and then he got out at the end of 2000. He knows that there are ways to make money, smart ways that don't require you to own stocks blindly. There are other investments that won't send you to the poorhouse.

This book will tell you what went wrong, who the bad guys were, and what you have to do to restore your financial health. You can't just close your eyes. Ignoring Wall Street isn't the answer. Cash alone isn't the answer. This book has the answers.

Worth every penny.

1 out of 5 stars The title of this book should be YOU GOT SCREWED! AND HOW JIM CRAMER SCREWED YOU!.......2007-02-18

In late December 1999/early January 2000 at the height of the tech bubble, Jim Cramer appeared on CNBC and screamed this mantra like a maniac at viewers, "If you don't buy ICGE now you are an idiot!! ICGE -- ICGE -- I SEE GE -- I SEE THE NEXT GE -- Get it -- Get it now!" If I remember correctly those were the words he screamed in a fury. The word "idiot" may have been "imbecile" but the point is he wanted to make you feel really stupid if you missed this golden opportunity.

Shortly afterwards the stock started dropping like a rock and Internet Capital Group fell from something like $220 a share to half that in no time flat. Now check out a chart to see where the next General Electric is.

How Jim Cramer got away with this is beyond me. I just found an article in my archives dated 12/20/1999 about "Why Jim Cramer is a Big Fan of Internet Capital Group" but because of copyright laws I don't believe I am allowed to post it here. In the article he stated that his hedge fund owned a large stake in the company and that he was looking to buy more on any pullbacks. What a load of bull. When he says BUY, you should say BYE as you switch to another TV channel.

Good luck if you put your trust in this guy.

3 out of 5 stars Typical Cramer Rant - But What's The Point?.......2006-12-31

Don't get me wrong, I kinda like Cramer. He's entertaining. He's funny. He's run a successful Hedge Fund. He's made a lot of money. He's also often wrong.

Here's my personal experience with Cramer. A few weeks before the collapse of Tyco, Cramer was hyping the stock on his Real Money radio program. If I remember the quote correctly he said, "I would be remiss if I didn't buy Tyco at these levels". So Tyco fell to $32, I bought 1,000 shares. Tyco went to $35 a week later, I sold and made a sweet profit. A week after that Tyco tanked. The rest is history.

I got lucky.

Even though I made money, I suddenly realized how foolish it is to buy stock on the advice of any pundit. I counted my blessings, thanked God I didn't get creamed, and learned a valuable lesson. I wonder how many others weren't so fortunate.

This book fires bazooka rounds at the corporate excesses of the 90's and early years of the millennium. It lobs well deserved grenades into the boardrooms of the brokerage industry. Then it spits a pea shooter's worth of advice at how to avoid getting "screwed" again. Like I said, Cramer is entertaining.

Clearly, Cramer is angry at something or somebody. Maybe he's feeling guilty about his own contributions to the largess of Wall Street and wants to make amends. If that's the case then I understand why he wrote this book. It's a laudable goal. Who knows?

What I do know is there's nothing really new in this book. It provides some very interesting background information about a pivotal point in the country's financial history. It readdresses some of the deck stacking practices of the financial services industry, and it rehashes, in a minimal way, sage self-help advice that can be found in numerous other places for free.

It's not a bad book. And Cramer is not a bad guy. I actually believe the Real Money Cramer is a far different man than the Hedge Fund Cramer. A man for the better in my opinion. So I give him the benefit of the doubt.

If you know nothing about how corporate shenanigans work or how Wall Street works this book is a good primer. You'll just have to go elsewhere for the details.

1 out of 5 stars Unbelievable.......2005-05-28

James J. Cramer is responsible for much of what occurred during the tech bubble. He was a cheerleader for the tech boom and now says that others got screwed? HE WAS DOING THE SCREWING! This is hypocrisy at its best.

From his near firing at Goldman to the collapse of his own company (TheStreet.com is down 90% plus from its IPO price) Cramer is a genius - at cashing in on his own failures.

Do not touch this book with a 50 foot pole.

5 out of 5 stars Trust no stock under $30????.......2005-05-14

Jim Cramer rules. Anyone who can mix schadenfreude (German for vicarious pleasure in others' misery), Pangloss from CANDIDE, sports analogies, and pop culture references with a straight shooting approach to finance and investing is cool. More importantly, he does a better, more readable job of dissecting big bad Corporate America than Michael Moore ever could (Cramer and Moore both got skewed in a bad-guy list of RADAR that stated the scariest facts about both, respectively, were "Is married and has children," and "Won an Oscar"). Jim Cramer isn't a get-rich-quick franchise.

    Book Description

The subject of ethics in criminal justice has become more important over the last decade as increasing concern about the accountability of law enforcement and public authorities has prompted ethical questions regarding the actions of those who exercise power over citizens. Criminal Justice Ethics: Theory and Practice provides an overview of the expected standards of behavior and ethical issues that confront those in the various fields of criminal justice.

This book takes a sociological approach to criminal justice ethics by emphasizing the social and historical aspects of ethical inquiry. Author Cyndi Banks presents a unique discussion of ethical issues by exploring moral dilemmas faced by professionals in the criminal justice system before examining the major theoretical foundations of ethics. This distinct organization of Criminal Justice Ethics allows readers to understand real-life ethical issues before grappling with philosophical approaches to the resolution of those issues.

      Book Description

Restorative Justice has emerged around the world as a potent challenge to traditional models of criminal justice, and restorative programmes, policies and legislative reforms are being implemented in many western nations. However, the underlying aims, values and limits of this new paradigm remain somewhat uncertain and those advocating Restorative Justice have rarely engaged in systematic debate with those defending more traditional conceptions of criminal justice. This volume, containing contributions from scholars of international renown, provides an analytic exploration of Restorative Justice and its potential advantages and disadvantages.

        Book Description

In the latter half of the twentieth century, there has been a sharp decline in confidence in sentencing principles, due to a questioning of the efficacy of punishment. It has been very difficult to develop consistent, fair, and humane criteria for evaluating legislative, judicial and correctional advancements. b /b b i The Practice of Punishment /i /b offers a comprehensive study of punishment that identifies the principles of sentencing and corrections on which modern correctional systems should be built. br br The theory of punishment that emerges is built on the view that the central function of the law is to reduce the need to use force in the resolutions of disputes. In this text, Wesley Cragg argues that the proper role of sentencing and sentence administration, as well as policing and adjudication, is to sustain public confidence in the capacity of the law to fulfill that function. Cragg believes that sentencing and corrections should be guided by principles of restorative justice, and he contends that inflicting punishment is in itself not a legitimate objective of criminal law. br br b /b b i The Practice /i /b b /b b i of Punishment /i /b is a philosophical account of punishment, sentencing, and correction which draws strongly on first-hand experience of penal practices, diverse recent studies, government reports, position papers, crime surveys, and victim concerns. It will be of special interest to applied ethicists, those concerned with the theory and practice of punishment and policing, and criminal justice scholars and lawyers.

        Book Description

Anyone who has sat on a jury or followed a high-profile trial on television usually comes to the realization that a trial, particularly a criminal trial, is really a performance. Verdicts seem determined as much by which lawyer can best connect with the hearts and minds of the jurors as by what the evidence might suggest. In this celebration of the American trial as a great cultural achievement, Robert Burns, a trial lawyer and a trained philosopher, explores how these legal proceedings bring about justice. The trial, he reminds us, is not confined to the impartial application of legal rules to factual findings. Burns depicts the trial as an institution employing its own language and styles of performance that elevate the understanding of decision-makers, bringing them in contact with moral sources beyond the limits of law.

Burns explores the rich narrative structure of the trial, beginning with the lawyers' opening statements, which establish opposing moral frameworks in which to interpret the evidence. In the succession of witnesses, stories compete and are held in tension. At some point during the performance, a sense of the right thing to do arises among the jurors. How this happens is at the core of Burns's investigation, which draws on careful descriptions of what trial lawyers do, the rules governing their actions, interpretations of actual trial material, social science findings, and a broad philosophical and political appreciation of the trial as a unique vehicle of American self-government.

        1 out of 5 stars Look elsewhere..........2005-03-22

This book is so bad I don't know where to begin. FIrst, it fails to be an adequate description of, or encomium for, jury trials. (For that, see Jeffrey Abramson's book, WE THE JURY.) Second, it fails to apply real jurisprudence (like Lon Fuller or HLA Hart) to this "new" area of thought, and it fails pathetically to mix in critical theory. (Why is Hannah Arendt thrown into nearly every paragraph?) I regret that I didn't click on the "look inside" feature of this website. Two pages of nonsense would have been enough. Save your money, save your time, by ignoring this brain-dead drivel.

5 out of 5 stars A theory book that delivers on its promises.......2005-02-13

A Theory of the Trial brilliantly delivers what its title promises: an unconventional way of thinking about the idea of justice. If you are looking for a manual of trial practice, an anthology of case studies of famous trials, a collection of stories about notorious trials in history, look elsewhere. But if you are curious about the guiding principles-often unacknowledged and unexamined-operating beneath the surface of the trial system, forming its foundation, then A Theory of the Trial is for you.
Burns, a practicing trial lawyer, professor of law, and professional philosopher, contrasts "the received view" (the view "according to the officials") about how juries (and judges) behave and the complex "intellectual operations" they actually perform while evaluating issues during the performance of the trial. Close study of four trials and reference to many others reveal decidedly more intricate intellectual operations than the official, received view understands. Juries continually sort through what Burns calls "a web of languages" spun during the trial. The key is paying attention to those languages. He does so in painstaking detail, thus setting up his final chapters, which require a patient reader. There Burns's philosophical mind goes to work, thinking systematically through competing positions and working toward his own. The argument proceeds brilliantly from its premises. Despite a pattern of references to scores of previous thinkers, it is conducted clearly and lucidly.
For Burns, the trial is "one of the greatest achievements of our public culture." Ordinary citizens arrive at "truth-for-practical-judgment," truth that must be put into practice. Thereby, they influence public events in ways different from official, direct, top-down control. Does he overvalue the common sense of ordinary citizens? Perhaps, but today where else can we look for common sense and hard-won practical judgment? Burns's book makes its demands, but it delivers.

1 out of 5 stars Litigation for people who don't litigate.......2005-02-03

This book is what it is -- an attempt to talk about trials metaphysically. As a trial lawyer, I thought I would get some insight into how to think about my job from a different perspective, but I was disappointed. This book isn't very deep and all the name-dropping that goes on isn't really explained. (Did the author really read all those philosophers, or just steal their quotes? I can't tell.) The work stinks like a dissertation, maybe the author is just out of grad school and is trying to prove himself.

1 out of 5 stars Not worth paying for.......2005-01-25

This book attempts to harness two unrelated discourses and apply them to the American Jury System. First, it wants to use the wild, free-willing, MTVish, academia-lite trial advocacy theories of people like Steve Lubet (author of Nothing But the Truth: Why Trial Lawyers Don't, Can't, and Shouldn't Have to Tell the Whole Truth), where the existence of truth itself is denied or ignored and trial law becomes theater, law school becomes charm school. (Tell a story, develop a theme, project to the jury, wear the right clothes, forget the truth!) Second, it wants to add some muscle to this limp line of thinking by speaking of it in philosophical/hermeneutical terms. All the big guns come in, from Aristotle to hints of Bakhtin. It doesn't work. The book comes across as a Menippean Satire, a joke, something more like Rabelais than Immanuel Kant. The problem is that trial theory (the first strain) is so intellectually and morally bankrupt that putting fancy clothes on it makes it more a clown than an aristocrat. The clothes don't fit.

1 out of 5 stars Avoid This Book.......2004-05-26

This book reminds me of everything I hated about law school at Yale--the philosophy, the pretension, the utter lack of interest in the real world.

The author writes a book about trials--and yet discusses almost no trials at all. Apparently Burns is a failed philosophy professor, because he has infintely more interest in his own mind than in what goes on in the courtroom. It is books like these that astound me--how can anyone think this is good enough to publish?

The prose is clunky, and Burns finds endless ways to make trials utterly dull. His ideas reduce to no more than the generalities one learns in Trial Practice classes--tell a strong story; every element of your case should reflect the theme; juries are unpredictable.

This book is awful. But then, Burns is probably a poseur--no trial lawyer can be as dull as Burns is and still survive. If one really wants to study the essence of trials, try reading Vincent Bugliosi.
